As HR Works previously announced, the OFCCP has launched its new Contractor Portal, through which Federal contractors and subcontractors (“contractors”) will need to certify the compliance of their affirmative action plans (AAPs). All ‘service and supply’ contractors are impacted by this new requirement. Construction contractors are exempted from using the portal at this time.
Registration for the contractor portal opened on February 1, 2022. There are several steps contractors must take in order to register for the portal, before they can certify their AAP. HR Works has developed a job aid to guide you step by step through the registration process.
CERTIFYING THE COMPLIANCE OF YOUR AAP
Once registered, contractors have between March 31, 2022 and June 30, 2022 to certify the compliance of their AAP. There are a few timing considerations to be aware of, depending on plan year:
We can assume that in the future, the agency will use this new database to generate lists of companies being scheduled for compliance evaluations.
It is important to note that certifying that you are in compliance does not exclude you from being selected for a compliance evaluation, and contractors can face a variety of penalties if they are found to be out of compliance. Learn More.
