
On August 29, 2022, the Office of Federal Contract Compliance Programs (OFCCP) issued a reminder to affirmative action employers that the Contractor Portal remains open for certification and the Technical Help Desk remains available for employers in need of technical support.
Federal contractors and subcontractors (collectively, contractors) who are required to certify and have not yet done so are encouraged to complete the certification process as soon as possible. The certification deadline passed on June 30, 2022. OFCCP has indicated that employers who, 1) have not certified, or 2) certified that they are not in compliance, will be more likely to be selected for an upcoming compliance evaluation.
Contractors who failed to certify by September 1, 2022, will face further scrutiny from other government agencies as well. OFCCP announced that those contractor names would be compiled and distributed to federal agency contracting officers. The intent is for those officers to then assist OFCCP in gaining compliance from the employers.
OFCCP’s Contractor Portal is new in 2022. ‘Service and supply’ contractors with a Federal contract or subcontract valued at $50,000 or more, and 50 or more employees, are required to certify. The agency has posted answers to frequently asked questions and other resources for employers on its website.
