
While the law did not change, the US Equal Employment Opportunity Commission (EEOC) has updated its’ “Know Your Rights: Workplace Discrimination Is Illegal” Poster.
All employers that are covered by any of the following federal anti-discrimination laws are required to post this notice:
- Title VII (15 or more employees);
- The Age Discrimination in Employment Act (ADEA) (20 or more employees);
- The Americans with Disabilities Act (ADA) (15 or more employees);
- The Genetic Information Nondiscrimination Act (GINA) (15 or more employees);
- The Equal Pay Act (EPA) (virtually all employers); and
- The Pregnancy Discrimination Act (PDA) (15 or more employees).
Next Steps for Employers
Employers must post this updated notice in a prominent, accessible location in the workplace where notices to applicants and employees are customarily posted. Employers may also post the notice electronically in a prominent location on its website. However, it should be noted that in most cases, electronic posting is not a substitute for the physical posting.
Further, printed notices should also be made available in an accessible format, as needed, to persons with disabilities that limit the ability to see or read. Notices can be recorded on an audio file, provided in an electronic format that can be utilized by screen-reading technology or read to applicants or employees with disabilities that limit seeing or reading ability.
Employers should contact their labor poster vendor to ensure receipt of an updated poster. Employers may also download this poster directly from the EEOC’s website. An electronic format for screen readers and electronic posting is also available.
